Article 2 – Applicability
These terms and conditions apply to every purchase made through our website by both consumers and business customers. Any deviations from these terms are only valid if expressly agreed upon in writing via email.
Article 3 – Products and Offer
Our stroopwafel artworks are unique, handmade art objects and are sold “as is”. Minor variations in appearance, color, and texture may occur and do not constitute grounds for replacement or warranty claims. The gold leaf used is highly delicate and may show signs of wear or damage over time, even under normal use or storage. This fragility is inherent to the artwork and contributes to its unique character. We recommend storing the artwork in a cool and dry environment. All images shown are for illustrative purposes only. All prices include VAT.
Article 4 – Orders and Agreement
Orders can only be placed via our website. An order becomes final and binding once payment has been successfully completed.
Article 5 – Prices and Payment
Payments must be made directly online using the payment methods offered on our website. Payment after delivery is not possible.
Article 6 – Delivery
We aim to ship orders within 1–3 business days after receipt of payment. After dispatch, standard delivery times apply depending on the destination (The Netherlands or EU). Shipping costs are borne by the buyer. We take due care in packaging and dispatching the artwork. The risk of loss or damage transfers to the buyer at the moment the order is delivered to the specified delivery address.
Article 7 – Returns, Warranty, and Complaints
Consumers have the right to return the artwork within 14 days of receipt, without stating a reason. Return shipping costs are borne by the buyer. The artwork must be returned in its original condition and packaging. After receiving and inspecting the returned product, we will process the refund within 14 days.
If the artwork is damaged during shipping, this must be reported to us immediately by email. We will then provide an appropriate solution, such as replacement or refund.
Business customers are not entitled to a right of return.
Article 8 – Liability
Our liability is limited to a maximum of the purchase price of the artwork. We are not liable for damage resulting from improper use, normal wear and tear, or damage caused by mishandling. The stroopwafel artwork is strictly NOT intended for consumption.
Article 9 – Intellectual Property
All intellectual property rights related to the artworks remain with The Coco Caramel Company. Customers are permitted to photograph and share the artwork on social media, provided that The Coco Caramel Company is clearly credited. Any commercial reproduction or use of the artwork without prior written consent is strictly prohibited.
Article 10 – Privacy
We collect personal data via our website solely for the purpose of processing orders. Personal data is handled with care and in accordance with applicable data protection laws. Personal data will only be used for marketing purposes if explicit consent has been given.

Article 11 – Force Majeure
We are not liable for failure to fulfil our obligations if such failure is the result of force majeure, including but not limited to illness, natural disasters, production issues, or delays caused by carriers.
Article 12 – Governing Law and Disputes
All agreements are governed exclusively by Dutch law. In the event of a dispute, we will first seek to resolve the matter amicably. If no solution can be reached, the dispute will be submitted to the competent court in the Netherlands.
